Privacy Policy

Groupmatics, LLC (“Groupmatics”, “we”, “us”, “our”) respects the privacy of our customers and users (“you,” “your” or “yourself”) of our websites (www.groupmatics.com , www.groupmatics.events , and https://live.gview.events) portals, mobile applications and services (collectively “Websites and Services”). Accordingly, this Privacy Policy explains how information is collected or otherwise submitted by you via our Websites and Services is used, shared and protected.

 

Consent and Data Transfer: By using our Websites and Services, you signify that you have read, understand, and agree to be bound by the Terms of Use and this Privacy Policy and consent to the collection, use and disclosure of your information, including Personal Information, in accordance with this Privacy Policy. If you do not agree to the Terms of Use and this Privacy Policy, you must discontinue using our Websites and Services. 

Our Websites and Services are hosted and operated in the United States (“U.S.”) and are intended for users located in the U.S. If you are located outside United States and choose to use our Websites and Services and provide data to us, please note that we transfer the data we collect, including Personal Information, to the U.S. and process and store it there. The data protection laws in the U.S. may differ from those of the country in which you are located, and your Personal Information may be subject to access requests from governments, courts, or law enforcement in the U.S. according to U.S. laws.  Your above-stated consent to the Terms of Use and this Privacy Policy, followed by your submission of data represents your agreement and consent to this such transfer, processing, and storage of your Personal Information, whether provided by you or obtained through a third party, in the United States, including the hosting of such Personal Information on U.S. servers. You are also consenting to the application of U.S. federal law and Ohio state law in all matters concerning our Websites and Services, Terms of Use and this Privacy Policy.

If you reside in the European Union (“EU”), United Kingdom, Lichtenstein, Norway, Iceland or Switzerland, you may have additional rights with respect to your Personal Information, including rights under the EU’s General Data Protection Regulation (“GDPR”), as outlined below in the section titled, Privacy Rights of Users in the European Economic Area (EEA)“.

 

What Information We Collect:

 

Personal Information — The term “Personal Information” in this Privacy Policy means contact information (e.g., name, address, email address, mailing address, telephone number) and any other information that personally identifies an individual. In general, we collect Personal Information in connection with the provision of our Services and establishment of an account with us. In those cases, we require that you voluntarily provide certain Personal Information, including your name, email address, mailing address, and phone number, username and password and you can optionally provide gender and date of birth information. If payment is required, we will also collect (i) your name as it appears on the card; (ii) the credit card type; (iii) a valid credit card number; (iv) the date of expiration of your credit card; (v) your billing address; and (vi) any activation numbers or codes needed to charge your card. We do not process or store your payment information, but rather that information is provided directly to our third-party payment processors whose use of your Personal Information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. We may also collect Personal Information when you sign in to our Websites using a social networking account such as a Facebook or Google account. By using such sign-in option, the social networking site will also know that you have a Groupmatics account. To learn more about the privacy and information collection and sharing practices of a social networking site on which you interact with Groupmatics, please refer to the privacy policy for that social networking site.

We may also collect Personal Information that you submit to us voluntarily when you interact with the Services or correspond with us via email or the contact feature on our Websites. We may combine your Personal Information with information we receive offline, such as when you interact with our customer service group, or that we obtain through third party sources.

You can always decline to provide any Personal Information to us—it is your choice, and you are under no obligation to provide Personal Information to us. However, if you decide not to provide such Personal Information, then you may not be able to use or purchase the Services. At any point, you may access, review, and modify your Personal Information from your account, or by contacting us as stated in the “How to Contact Us” section below.

Non-personal information and Cookies — As part of the standard operation of our Websites, we may passively collect certain non-personal information from you including, but not limited to: your browser type (e.g., Firefox or Internet Explorer), operating system (e.g., Windows or Macintosh), Internet Service Provider (“ISP”), IP address, web sites visited and the domain name from which you accessed our Websites (e.g., yahoo.com). In addition, we may collect information about your browsing behavior, such as the date and time you visited our Websites, the areas or pages of our Website that you visit, the amount of time spent viewing our Websites, the number of times you return to our Website and other click-stream data.

Like most websites we may also use “cookies” which are bits of information (small text files) that are stored on a visitor’s hard drive and enables the server to recognize your computer when it visits again. Cookies enable us to track statistical information about navigation to and throughout certain areas of our Websites. Cookies also help us learn how groups of people use our Websites, and help us collect information to track usage patterns, browsing behavior and assess web content and structure. You can choose to have your computer alert you when a cookie is being sent, or you can choose to turn off such cookies through your browser settings.  Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies.

How and Why We Use Personal Information: The Personal Information that you provide to Groupmatics may be used, processed and stored by us for the following purposes: (i) to respond to your comments, requests for information and inquiries; (ii) to permit access to our Websites and Services; (iii) to administer your account and verify your identity; (iv) to process your orders/purchases; (v) to provide/fulfill the Services and customer support; (vi) to communicate with you about the Services; (viii) for administrative purposes.

If you voluntarily submit your email address to receive information, we may subsequently issue Service related information to you via email, including technical advisories. If, at any time after registering, you change your mind about receiving Groupmatics emails, you can “opt out” via the “opt out” link included in each email. You should also be aware that any Personal Information or other information that is voluntarily posted by you to a public area of our Websites may be viewed and used by other users.

 

How We Use Cookies and Non-Personal Information: Information that we collect from you regarding your browser type, operating system, ISP, IP address, web sites visited, the domain name from which you accessed this Website or other click-stream data is not used by us to personally identify you, but, instead, may be compiled and analyzed internally on an aggregated basis to measure our users’ habits. This helps us measure the use of our Websites, improve the content of our Websites and to better understand and serve our users. We may use the services of vendors to help us measure and personalize our advertising on our Websites who may collect and analyze anonymous usage and volume statistical information from our users.

 

When and Why We Share Information: Except as otherwise stated in this Privacy Policy, we do not trade, rent, or share the Personal Information that we collect with unaffiliated third parties including for their own independent marketing or use. We may disclose your Personal Information: (i) to third party vendors who help us operate our business, maintain our Websites and administer our Services, including without limitation vendors that help us verify your identity and process payments, in which case we will require such vendors to honor this Privacy Policy and not retain, use or disclose any Personal Information for any purpose other than the performance of their services to us; (ii) to third parties to whom you ask or authorize us to send Personal Information (including other users) by opting in and the organizer of any groups or organizations you belong to on our Websites in order to facilitate the Services you have selected; (iii) to any subsidiary organizations, joint ventures, or other organizations under our control (collectively, “Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy; (iv) to an entity that merges with us, acquires us, or purchases substantially all of our assets, in which case such entity may continue to process your Personal Information as set forth in this Privacy Policy; or (v) if we believe in good faith that such disclosure is necessary to: (a) resolve disputes, investigate problems, or enforce our Terms of Service; (b) comply with relevant laws and court orders or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity in which case we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; (c) protect and defend our rights or property including without limitation the security and integrity of our Websites and Services and databases, or the rights and property of you or third parties; and (d) to protect against misuse or unauthorized use of our Website; take precautions against legal liability.

 

Links To Other Sites: Our Websites may contain links to other third-party websites, specifically including our payment portal which is hosted and operated by Stripes. While we try to link only to third-party websites that share our respect for privacy, our Privacy Policy does not extend to and may differ from third-party websites that can be accessed through links on our Websites. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services. We strongly suggest that you to review the privacy policies on the third-party website before registering with those sites and/or submitting any Personal Information.

Data Controller: Groupmatics will be the controller of your Personal Information that is provided, collected and/or processed pursuant to this Privacy Policy, except where otherwise expressly stated herein. When acting as a data processor, Groupmatics will only process Personal Information in accordance with users’ instructions and this Privacy Policy. Groupmatics’ vendors, affiliates or subsidiaries may also act as data controllers or processors in connection with the purchase of Services.

 

Security of Collected Information: To help protect against the loss, misuse and alteration of your Personal Information, Groupmatics and its hosting vendor employ reasonable security measures and technology to help prevent interference or access from unauthorized persons including, without limitation, physical access controls and Internet firewalls. Please note, however, that we cannot, and we do not believe anyone can, genuinely guarantee or warrant absolute, 100% security of Personal Information disclosed or transmitted via the Internet to us or a third-party, nor can we fully eliminate risks of unauthorized entry or use, hardware or software failure and other factors that may compromise the security of your Personal Information at any time. Consequently, you provide your Personal Information and other information to us at your own risk and absent our gross negligence, you agree to not hold Groupmatics responsible for the theft, destruction, loss, misuse, alteration, damage or inadvertent disclosure of your Personal Information or other data under our control. Remember to close your browser window when you are finished using our Websites to ensure that others cannot pose as you online.

 

How Long We Retain Your Information: Unless we have deleted your Personal information in accordance with your request pursuant to this Privacy Policy, we will retain your Personal Information for so long as your account is active or as needed to provide the Services.  If you wish to cancel your account or request that we no longer use your Personal Information, please contact us as stated in the “How to Contact Us” section below.  Please note, however, we will retain and use your Personal Information to the extent necessary to comply with applicable laws, resolve disputes, or enforce our contractual rights.

 

Privacy Rights of Users in the European Economic Area (EEA): Under the EU General Data Protection Regulation 2016/679 (“GDPR”), effective as of May 25, 2018, European Union data subjects are entitled to certain specific rights with respect to processing of their personal data/Personal Information including, in certain circumstances, the right to:

  • Request access to your Personal Information held by us;
  • Request the correction of Personal Information that is inaccurate, incomplete, unnecessary or outdated;
  • Request erasure of your Personal Information within a reasonable period of time, however we may be unable to erase all Personal Information if it is impossible due to limitations of technology or if we are mandated by applicable law to retain the Personal Information;
  • Object to the processing of your Personal Information, including the right to opt-out of receiving direct marketing, however we will continue to use Personal Information for the limited purpose of communicating important notices to you relating to purchases, changes to Services or policies, and other reasons permitted by law;
  • Request restriction of the processing of your Personal Information for certain reasons such as inaccuracy of the information;
  • Request to receive your Personal Information in order to transfer it to another data controller and the same will be provided in a structured, secure, commonly used and machine-readable format;
  • Withdraw your consent to the use of your Personal Information, at any time; and
  • Make a complaint to an EU Data Protection Authority when you believe we have not complied with our obligations under this Privacy Policy or applicable European data protection law (including the GDPR).

Except as otherwise provided in this Privacy Policy or required by applicable laws and regulations, we will not transfer your Personal Information to third parties located outside of the EEA without taking steps to ensure adequate protection under the GDPR.  If a third party is located in a country not recognized by the EU Commission as providing an adequate level of protection, we will use appropriate measures, such as entering into standard contractual clauses, approved by the EU Commission, to protect your Personal Information.

Children’s Privacy Rights: In compliance with the Children’s Online Privacy Protection Act (“COPPA”), Groupmatics does not knowingly collect or solicit personally identifiable information from anyone under the age of 13. If you are under the age of 13, please do not provide us with any Personal Information. If we learn that we have inadvertently obtained Personal Information from a child under the age of 13, we will delete that information as soon as possible. If you believe that a child under the age of 13 has submitted Personal Information to us, the parent or guardian of that child should contact us as stated in the “How to Contact Us” section below.

 

California Privacy Rights: California Civil Code Sections 1798.83-1798.84, permit users of our Websites and Services who are California residents to request the categories of Personal information which we share with our affiliates and/or third parties for marketing purposes, if any, and the contact information for such affiliates and/or third parties. If you are a California resident and would like to make such a request, please contact us as stated in the “How to Contact Us” section below.

 

Changes To This Privacy Policy: Groupmatics, LLC reserves the right to change this Privacy Policy at any time in its sole discretion and/or to update this Privacy Policy from time to time for reasons such as operational practices or regulatory changes. The most recent version of the Privacy Policy will always be posted on our Sites, with the “Effective Date” posted at the top of the Privacy Policy. If we make any material changes to our Privacy Policy, we will also send you notice to the last email address you have provided to us. Continued use of our Websites and Services on or after the Effective Date of the modified Privacy Policy indicates your acknowledgement of the same and your agreement to be bound by the terms and conditions of the Privacy Policy as modified. We encourage you to review the Privacy Policy regularly for the latest information on our privacy practices.
